What this update is about
In April 2026 we released a fix to the calculation engine concerning the classification of virtual currencies from the Binance, Bybit and Coinbase exchanges. Earlier versions of the tool could wrongly place some tokens (e.g. BSW, APENFT and other less popular cryptocurrencies) in section C/D of the PIT-38 form (securities) instead of section E/F (virtual currencies). In addition, Binance „Asset Recovery" operations (internal balance write-offs) were wrongly treated as sales with zero revenue.
What exactly changed
The fix addresses three related problems:
- Unknown tokens (outside the list of the ~290 most popular cryptocurrencies) are now automatically classified as cryptocurrencies on crypto-only exchanges (Binance, Bybit, Coinbase), rather than as “Other”.
- „Asset Recovery" operations on Binance are treated as an internal balance write-off — they do not create a taxable event (in line with art. 17 ust. 1 pkt 11 of the PIT Act — no disposal for consideration).
- Fiat currencies (TRY, RUB, UAH, BRL, ARS, NGN) are now correctly classified as cash on Bybit and Coinbase, not as cryptocurrencies.
Legal basis
Part C/D (art. 30b ust. 1 of the PIT Act — securities and financial instruments) and part E/F (art. 30b ust. 1a — virtual currencies) are settled separately in PIT-38: income from virtual currencies is not combined with income from other capital gains. Losses from one part cannot be offset against income from the other. Assigning tokens to the correct part is necessary for the tax to be settled correctly.
Losses from selling cryptocurrencies (part E/F) cannot be deducted from income from selling shares (part C/D), and vice versa. Each of these parts is settled separately.
Who this update affects
This update affects you if you imported files from Binance, Bybit or Coinbase into our tool that contained tokens outside the list of the 290 most popular cryptocurrencies (e.g. BSW, APENFT, many altcoins). If you used only traditional brokers (Trading 212, DEGIRO, IBKR, Exante and others), this update does not affect you.
What to do
- 1Log in to the tool and go to the Calculations tab — the new engine version will automatically recalculate your data with the new classification. The system will show the banner „Dane zostały automatycznie naprawione" (“Data has been automatically repaired”).
- 2Compare the current results with your previous return. If the values in sections C/D and E/F have changed, your previous return contained a classification error.
- 3If you have already filed a PIT-38 return for 2024 or 2025, consider filing a correction under art. 81 of the Tax Ordinance (Ordynacja podatkowa).
- 4If in doubt, consult a licensed tax advisor or apply for an individual tax ruling from the National Revenue Information service (Krajowa Informacja Skarbowa, KIS).
If your previous return wrongly offset losses between parts C/D and E/F, your tax base may have been understated. In that case, filing a correction may require you to pay the additional tax together with late-payment interest (art. 53 of the Tax Ordinance (Ordynacja podatkowa)). Filing a legally effective correction and paying the full arrears protects you from a penalty (art. 16a of the Fiscal Penal Code (KKS)) — provided the correction is not filed during a tax audit or tax proceedings.
Binance „Asset Recovery" operations
If your Binance file contained rows labelled „Asset Recovery” (an internal settlement of balances by the exchange — e.g. a write-off of delisted or lost tokens), please note that such operations are not a disposal of virtual currency for consideration within the meaning of art. 17 ust. 1 pkt 11 of the PIT Act. There is no reciprocal consideration and no buyer. No revenue and no additional cost arise: the expenses of buying these tokens were already included in the costs of the year in which they were incurred (art. 22 ust. 14–16). The token has been removed from the record of assets held, but no tax item has been generated.
